New phase in reporting obligation for public procurement: this will change from 2025
Does your company sometimes participate in public procurement? As of 1 January 2025, an annual reporting obligation will be introduced for contracting authorities. This obligation applies not only to follow-up contracts resulting from framework agreements, but also to contracts with a limited value. Lawyer specialising in public procurement Matthias Castelein summarises the basic principles.
New rules for reporting on public contracts
Januari 2025 markeert een nieuwe fase in de rapporteringsverplichting voor gegunde overheidsopdrachten. Concreet houdt deze jaarlijkse verplichting het volgende in:
1. Follow-up contracts from framework agreements
Contracting authorities will have to report a number of key data annually on these follow-up contracts from framework agreements. This includes the total value of the contracts per beneficiary company, broken down into works, supplies and services. To facilitate this process, the FPS Policy and Support (abbreviated as BOSA) has developed an online tool on the e-Procurement platform. The first report for the year 2024 must take place from 1 January 2025.
2. Public contracts with a limited value
An annual reporting obligation also applies from 2025 for contracts with a value between EUR 5,000 and EUR 30,000. This report contains similar key data as for follow-up contracts from framework agreements.
3. Exception for smaller government contracts
For contracts with an award amount of less than 3,000 euros, a report to the FPS BOSA is not required
